Marriage contract in Turkey

The marriage contract in Turkey is a civil contract that is organized by the marriage registration offices in the municipality, which is the authority authorized to conduct marriage transactions in Turkey, and the rest of the related arrangements. Unconfirmed marriages are not recognized by official contracts, and the Turkish government does not recognize religiously concluded contracts only as "a book by a sheikh."

Do foreigners have the right to confirm marriage in Turkey

Yes, of course, it is possible for foreigners, within the legal conditions and procedures for marriage in Turkey, to organize the marriage contract, whether one or both of the spouses are foreigners.

  • If one of the spouses is Turkish and the other is a foreigner, or the spouses are of two different foreign nationalities, the Turkish authorities only recognize the marriage contract concluded in the civil court in Turkey.

  • If the spouses are of the same nationality, the Turkish authorities recognize the contracts certified by their country's embassy or consulate, and the marriage in Turkey can also be confirmed in the civil court.

Conditions for marriage in Turkey

In order for marriage to be legalized in Turkey, Turkish laws impose several conditions on marriage applicants that must be fulfilled, which are:

Ability to marry

The ability to marry in Turkey is measured by two main factors, namely: mind and age

  • Married people should possess the mental capacity sufficient to make the decision to marry, as mental illness is considered an obstacle to establishing marriage in Turkey, unless the person with a health impairment or a person with special needs obtains a health report from the hospital indicating his eligibility for marriage.

  • As for ages, the minimum age that is allowed after reaching marriage in Turkey is 18 years, and there is an exception for those who reach the age of 16, provided that one or both parents attend and sign, and this exception is regulated in the municipality.

  • Regarding marriage for those under the age of 16, it is considered contrary to Turkish laws even if one of the parents agrees.Usually, the Turkish authorities in such a case separate the spouses, imprison the husband and the wife’s guardian and fine them financially.

 

Freedom from certain diseases

Some diseases may prevent marriage in Turkey, the most important of which are:

  • Mental illnesses: such as epilepsy, insanity, hysteria and other related diseases
